Introduction and definitions

In these AI Product Terms, "Back At You," "BAY," "we," "us," or "our" means Back At You, Inc. These AI Product Terms ("AI Terms") govern your use of the artificial intelligence features and agentic automation tools (collectively, the "AI Services") provided within the Back At You ecosystem. These AI Terms are in addition to, and incorporated into, our Terms of Service, and should be read together with our Privacy Policy. If these AI Terms conflict with the Terms of Service on an AI-specific matter, these AI Terms control for that matter.

1. The "be a good human" clause (acceptable use)

We provide tools to empower real estate professionals, not to cause harm. You agree not to use the AI Services to:

  • Material deception. Create deepfakes, synthetic media, or misleading content intended to influence a transaction through impersonation or material deception. Routine marketing copy (for example property descriptions) is permitted, and you must comply with all laws on bot disclosure.
  • Harmful content. Generate content that is defamatory, obscene, harassing, or that promotes illegal activity.
  • Professional impersonation. Provide tailored legal, financial, or medical advice. The AI is a productivity tool, not a licensed professional.
  • System abuse. Attempt to bypass safety filters or "jailbreak" the models, which may result in suspension or account termination.

2. AI disclaimer and human-in-the-loop requirement

Back At You provides the AI Services on an "as is" and "as available" basis.

  • No guarantee of accuracy. AI-generated content (social copy, images, video, CRM data, email drafts, and similar) may contain inaccuracies, hallucinations, or outdated information.
  • Mandatory human oversight. You are the human in the loop. You are solely responsible for reviewing, editing, and verifying all output before it is published, sent to a client, or used in a transaction.
  • Professional responsibility. Back At You is not responsible for errors in commission calculations, listing details, or legal disclosures generated by AI.

3. AI's role vs Back At You's role

While the AI may identify itself as an "assistant" or "marketing expert," it is an automated software process.

  • Delegation of authority. By enabling automated agentic features, you grant the AI authority to act on your behalf. Any action taken by the AI within the permissions you set (for example sending a communication, advertising, ordering print materials, or updating a CRM record) is deemed an action taken by you, and you are responsible for the scope of permissions you grant and any costs associated with them. For actions that move money or create financial liability (for example executing a commission payout, disbursement, or ad-spend commitment), the AI Services are designed to require affirmative human confirmation before the action executes, and you should not disable that confirmation. This is consistent with the human-in-the-loop requirement in Section 2.
  • Not a licensed agent. The AI is not a licensed real estate agent, broker, or legal advisor, and it does not create a fiduciary relationship between Back At You and you.
  • Permission management. You are solely responsible for managing the trigger settings and permissions of any AI agent. Back At You is not liable for actions that fall within the permissions you enabled.

4. Intellectual property (inputs and outputs)

  • Your input. You retain ownership of the data, prompts, and images you provide (the "Input").
  • The output. Back At You claims no ownership of the output (the "Output"). To the extent Back At You is deemed to hold any rights in the Output by operation of law, Back At You assigns to you any such rights it may now or hereafter hold and otherwise grants you a perpetual license to use the Output and covenants not to assert any retained rights against your use of it. Back At You does not guarantee that Output is unique or eligible for copyright or other protection, and some AI Output may not be protectable.
  • License to Back At You. You grant Back At You a non-exclusive, royalty-free license to use your Input and Output to provide, maintain, secure, and improve the AI Services. This license does not permit Back At You to sell your Input or Output or to use it for third-party advertising.

5. Data use, model training, and privacy

A. What data the AI Services use

The AI Services process the Input you submit and relevant account and content data needed to produce Output (for example a listing's details or a CRM contact you choose to include). The AI Services are not designed to require sensitive personal information to function.

B. Technology partners

Back At You uses third-party AI infrastructure to process your requests. Currently, our AI features run through DigitalOcean's inference platform, which routes requests to the applicable third-party AI models. Your Inputs may be shared through this infrastructure to process your requests. DigitalOcean is a subprocessor listed in our subprocessor list at backatyou.com/subprocessors, and its handling of Customer Data, including the model routing it performs, is subject to our Data Processing Addendum.

C. Model training and your choice

Back At You uses business-grade APIs and inference infrastructure that we configure with the intent, and whose provider terms as of the effective date provide, that our AI providers will not use customer Inputs or Outputs to train their models. We review these configurations and provider terms periodically, and we commit to configuring for no-training, but we do not guarantee third-party provider behavior. Back At You does not use your Input or Output to train Back At You models for other customers except in de-identified or aggregated form that meets the applicable legal standard. Where a training or product-improvement use is offered that is not necessary to provide the AI Services, we will provide a reasonable way to opt out before that use begins; you can also contact privacy@backatyou.com to request that your content be excluded from optional model-improvement uses. You acknowledge that the data-handling practices of third-party providers are governed by their terms and are outside Back At You's direct control.

D. Your responsibility for sensitive information

To protect your data, you agree not to input sensitive client personal information, private financial records, or confidential contract terms into AI prompts unless a feature is expressly designed for that data. You assume responsibility for the content you choose to submit to the AI Services.

E. Service interruption

Back At You is not responsible for model drift or outages from third-party providers. Inability to use a feature due to a third-party issue does not entitle you to a refund.

6. Limitations on publishing and sharing

If you publish AI-generated content, you must:

  • Fair Housing compliance. Ensure it complies with all Fair Housing laws and MLS and NAR rules. You agree to review AI output for biased or coded language that could violate the Fair Housing Act. Back At You disclaims liability for algorithmic discrimination in content you choose to publish.
  • Full responsibility. Assume legal and financial responsibility for claims of copyright infringement or defamation.
  • Platform disclosures. Comply with social platform terms (Instagram, LinkedIn, Facebook, TikTok, and others) on AI-generated content disclosure.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BACK AT YOU AND ITS AFFILIATES, OFFICERS, AND DIRECTORS ARE NOT LIABLE FOR INACCURATE OR HALLUCINATED CONTENT, LOSS OF DATA OR BUSINESS OPPORTUNITIES, OR FOR FINANCIAL TRANSACTIONS, COMMISSION PAYOUTS, OR COMMUNICATIONS EXECUTED AUTONOMOUSLY BY THE AI. AI-DRIVEN FINANCIAL INSIGHTS ARE FOR DECISION SUPPORT ONLY, AND YOU MUST INDEPENDENTLY VERIFY ALL FINANCIAL DATA BEFORE EXECUTION. YOUR USE OF, OR FAILURE TO USE, AVAILABLE REVIEW CHECKPOINTS, AND THE SCOPE OF PERMISSIONS YOU GRANT, ILLUSTRATE YOUR RESPONSIBILITY BUT ARE NOT CONDITIONS ON THIS EXCLUSION.

The overall limitation of liability and the aggregate liability cap in our Terms of Service apply to the AI Services and to these AI Terms, and nothing here increases that cap. The cap and these exclusions do not limit your indemnification obligations under Section 9 or under the Terms of Service.

8. Termination, logs, and changes

  • Access control. Back At You may suspend access for "be a good human" violations.
  • Logs. Back At You maintains logs of AI interactions in accordance with our Privacy Policy and retention schedules, and retains them only as long as needed for those purposes. We may disclose these logs as permitted or required by law, in response to legal process, or to establish or defend legal claims.
  • Experimental nature. AI features evolve rapidly, and Back At You may modify, pause, or discontinue specific AI capabilities at any time.

9. User indemnification

You agree to indemnify, defend, and hold harmless Back At You, its affiliates, officers, and directors from any claims, liabilities, and expenses (including reasonable attorneys' fees) arising out of (a) your use of the AI Services, (b) any Output you publish, (c) your violation of these AI Terms, or (d) any third-party claim that your Input or Output infringes their rights. This indemnity is in addition to the indemnity in the Terms of Service.

10. Relationship to other terms and contact

These AI Terms supplement the Terms of Service and Privacy Policy, which include the dispute-resolution, governing-law, and general provisions that apply to the AI Services. Questions: legal@backatyou.com.
