These AI Terms of Use (“AI Terms”) govern your use of the artificial intelligence features and agentic automation tools (collectively, “AI Services”) provided within the Back At You ecosystem. By using these AI Services, you agree to these terms in addition to our standard Terms of Service and Privacy Policy.
At Back At You, we provide tools to empower real estate professionals, not to cause harm. You agree not to use the AI Services to:
Material Deception: You may not use the AI to create "deepfakes," synthetic media, or misleading content intended to influence a transaction through personification or material deception. While routine marketing copy (e.g., property descriptions) is permitted, you must comply with all local and state laws regarding bot disclosure.
Harmful Content: You may not generate content that is defamatory, obscene, harassing, or promotes illegal activities.
Professional Impersonation: You may not use the AI to provide tailored legal, financial, or medical advice. The AI is a productivity tool, not a licensed professional.
System Abuse: Any attempt to bypass safety filters or "jailbreak" the AI models will result in immediate account termination.
Back At You provides the AI Services on an "AS IS" and "AS AVAILABLE" basis.
No Guarantee of Accuracy: AI-generated content (including social media copy, images, videos, CRM data, email drafts, etc.) may contain inaccuracies, hallucinations, or "information rot."
Mandatory Human Oversight: You are the "Human-in-the-Loop." You are solely responsible for reviewing, editing, and verifying the accuracy of all Output before it is published, sent to a client, or used in a transaction.
Professional Responsibility: BAY is not responsible for any errors in commission calculations, listing details, or legal disclosures generated by AI.
While our AI may identify itself as an "Assistant" or "Marketing Expert" within the interface, it is an automated software process.
Delegation of Authority: By enabling automated agentic features, you are granting the AI 'Delegation of Authority' to act on your behalf. Any action taken by the AI (e.g., sending a communication, advertising, ordering print materials, updating a CRM record, or calculating a commission) is legally deemed an action taken by you. You are responsible for the scope of permissions you grant to these automated tools and any costs associated with them.
Not a Licensed Agent: The AI is not a licensed real estate agent, broker, or legal advisor. It does not create a fiduciary relationship between BAY and the user.
Permission Management: You are solely responsible for managing the 'trigger' settings and permissions of any AI agent. BAY is not liable for actions taken that fall within the permissions you have enabled.
Your Input: You retain all ownership rights to the data, prompts, and images you upload (the "Input").
The Output: BAY claims no ownership rights over the Output. To the extent BAY is deemed to hold any intellectual property rights in the Output by operation of law, BAY hereby assigns those rights to you. However, BAY does not guarantee that Output is unique or eligible for copyright protection under current law.
BAY License: You grant BAY a non-exclusive, royalty-free license to use your Input and Output to provide, maintain, and improve the AI Services.
Technology Partners: BAY utilizes advanced third-party LLM providers (e.g., OpenAI, Anthropic, Google). You acknowledge that your Inputs may be shared with these partners to process your requests.
Data Flow & Training: BAY utilizes enterprise-grade APIs designed to prevent third-party providers from using customer data to train their base models. However, you acknowledge that the privacy and data handling protocols of third-party providers are beyond BAY’s direct control.
User Responsibility for PII: To ensure maximum data protection, you agree not to input sensitive client PII (Personally Identifiable Information), private financial records, or confidential contract terms into AI prompts. You assume all risk and liability for any data you choose to share with the AI Services.
Service Interruption: BAY is not responsible for 'model drift' or outages from third-party providers. Your inability to use a feature due to third-party issues does not entitle you to a refund.
If you publish AI-generated content, you must:
Fair Housing Compliance: Ensure it complies with all Fair Housing Laws and MLS/NAR regulations. You specifically agree to audit AI outputs for societal biases or 'coded' language that could violate the Fair Housing Act. BAY disclaims liability for 'algorithmic discrimination.'
Full Responsibility: Assume full legal and financial responsibility for claims of copyright infringement or defamation.
Platform Disclosures: Comply with social media platform terms (e.g., Instagram, LinkedIn, Facebook, TikTok) regarding AI-generated disclosures.
To the maximum extent permitted by law, Back At You, its managers, officers, shareholders, and board members shall not be liable for:
Inaccurate Content: Inaccurate content, hallucinations, or loss of data/business opportunities.
Financial Calculations & Transactions: AI-driven financial insights are for 'decision-support' only. BAY bears no liability for financial transactions, commission payouts, or communications executed autonomously by the AI if the user failed to utilize available review checkpoints or provided overly broad permissions. You must independently verify all financial data before execution.
Access Control: BAY may suspend access for "Be a Good Human" violations.
Right to Audit: BAY maintains logs of AI interactions in accordance with our Privacy Policy and data retention schedules. We reserve the right to provide these logs to authorities or use them in our own defense to demonstrate user-controlled actions.
Experimental Nature: AI features evolve rapidly. BAY reserves the right to modify, pause, or discontinue specific AI capabilities at any time without notice.
You agree to indemnify, defend, and hold harmless Back At You, its affiliates, officers, directors, and shareholders from and against any and all claims, liabilities, and expenses (including reasonable attorneys' fees) arising out of: (a) your use of AI Services; (b) any Output published by you; (c) your violation of these AI Terms; or (d) any third-party claim that your Input or Output infringes upon their rights.
